Terms and Conditions – Livestream Access

By purchasing or accessing the livestream service provided by The Dingwall & Highland Marts Limited (“the Company”, “we”, “us”, or “our”), you agree to be bound by the following Terms and Conditions. Please read them carefully before purchasing access.

1. Livestream Access

1.1 The Company provides a live video stream of sales events (“the Livestream”) on a Pay-Per-View (PPV) and subscription basis.
1.2 A one-off PPV purchase (£2) grants access to the Livestream for a period of 24 hours from the time of activation.
1.3 A monthly subscription (£5) grants unlimited access to the Livestream during the active subscription period.
1.4 Access is granted solely to the purchaser and must not be shared with third parties.

2. Permitted Use

2.1 The Livestream is provided for personal viewing purposes only.
2.2 You must not record, copy, reproduce, distribute, broadcast, publish, transmit, or otherwise make use of the Livestream or any part of it without prior written permission from the Company.
2.3 Any unauthorised use, including but not limited to recording or redistribution, may result in immediate termination of access without refund and may lead to legal action.

3. Privacy and Data Protection

3.1 The Livestream may capture images of customers, staff, vendors, and other attendees. Controlled access is implemented to protect the privacy and safety of all parties involved.
3.2 By accessing the Livestream, you agree to respect the privacy rights of individuals featured and not to misuse or attempt to identify or contact them based on livestream content.
3.3 The Company processes personal data in accordance with applicable UK data protection legislation, including the UK GDPR.

4. Payments and Refunds

4.1 All payments are non-refundable once access has been granted, except where required by law.
4.2 The Company reserves the right to change pricing at any time. Any changes will not affect purchases or subscriptions already active.
4.3 Subscription fees are charged monthly and remain active until cancelled by the user.

5. Donations

5.1 Any profits generated from Pay-Per-View purchases or subscription fees may be donated to a charity or charitable cause selected at the sole discretion of The Dingwall & Highland Marts Limited.
5.2 The Company may announce the chosen charity or charitable contribution from time to time, but is not obligated to do so in any particular manner.

6. Service Availability

6.1 While we make every effort to ensure uninterrupted access, the Livestream is provided on an “as available” basis.
6.2 The Company does not guarantee continuous, error-free, or uninterrupted streaming and accepts no liability for interruptions due to technical issues, maintenance, or circumstances beyond our control.

7. Suspension or Termination

7.1 The Company reserves the right to suspend or terminate access to the Livestream without notice if these Terms and Conditions are breached.
7.2 Misuse of the Livestream, including unauthorised recording or sharing, will be treated as a serious breach.

8. Limitation of Liability

8.1 To the fullest extent permitted by law, The Dingwall & Highland Marts Limited shall not be liable for any indirect, incidental, or consequential losses arising from use of the Livestream.
8.2 Nothing in these Terms limits liability for death or personal injury caused by negligence or for fraud.

9. Changes to These Terms

9.1 The Company reserves the right to update or amend these Terms and Conditions at any time.
9.2 Continued use of the Livestream following any changes constitutes acceptance of the revised Terms.

10. Governing Law

10.1 These Terms and Conditions are governed by and construed in accordance with the laws of Scotland.
10.2 Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the Scottish courts.
